1. Operator and Scope
These Terms of Service and Refund Policy govern your use of the Staymaker website at staymaker.app, the Staymaker app, and related services. Staymaker is operated by Emil Dellert under the business name Staymaker. By accessing or using our website or services, you agree to these terms. If you do not agree, please do not use the service.
2. Description of Service
Staymaker is software for vacation rental hosts to manage turnovers, cleaning schedules, maintenance tasks, team coordination, and related operational workflows. Features, availability, supported platforms, and plan limits may change over time. Current plan and pricing details are shown on our website or in the relevant checkout flow before purchase.
3. Accounts and Acceptable Use
You must provide accurate information when joining our waitlist, contacting us, creating an account, or using the service. You agree not to misuse the service, attempt unauthorized access, interfere with normal operation, upload unlawful content, or use Staymaker for fraudulent or illegal activity.
4. Pricing, Billing Channels, and Taxes
- Prices, billing intervals, and plan limits are shown before purchase.
- Direct or web purchases may be processed through Paddle, which acts as reseller and Merchant of Record for those orders.
- Purchases made through the iOS App Store are billed by Apple, not Paddle, and are subject to Apple billing, cancellation, and refund rules.
- Taxes, local currency conversion, and final charged amounts may vary depending on the billing provider, storefront, or applicable law.
5. Paddle Terms for Direct Purchases
For purchases completed through Paddle on our website or other direct channels, our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for those orders. Paddle handles billing-related customer service and returns for those orders. By completing a Paddle transaction, you may also be required to accept Paddle buyer terms and checkout terms.
6. Cancellation and Refund Policy
Subscriptions can be canceled at any time through the same billing channel used for purchase. Unless mandatory law requires otherwise, cancellation stops future renewals and does not automatically create a refund for amounts already charged.
- For Paddle-processed one-off purchases, buyers may request a refund within 14 days of the transaction date.
- For Paddle-processed subscriptions, buyers may request a refund within 14 days of the most recent renewal date.
- Any refund for a Paddle order remains subject to Paddle buyer terms, Paddle review, and any applicable mandatory consumer law.
- For buyers in the EU, EEA, or UK, any statutory withdrawal right for Paddle-processed digital services may end once you start using or benefiting from the service after agreeing to immediate access before the end of the withdrawal period.
- For purchases made through Apple's App Store, cancellation and refund requests must be made directly through Apple and are handled under Apple's own terms and support process.
7. Waitlist and Pre-Launch Access
Joining our waitlist or requesting early access does not create a binding contract or guarantee future availability. We may invite, limit, pause, or discontinue early access at our discretion.
8. Intellectual Property
All website content, software, branding, text, graphics, and related materials belong to Staymaker or its licensors and are protected by applicable intellectual property laws. You may not copy, redistribute, reverse engineer, or create derivative works except where expressly permitted by law.
9. Availability and Liability
We work to keep Staymaker available, secure, and accurate, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, Staymaker is not liable for indirect, incidental, special, consequential, or punitive damages. This does not limit liability where such limitation is not permitted under applicable law.
10. Changes to the Service or These Terms
We may update the service, pricing, features, or these terms from time to time. The current version will be posted on this page with an updated date. Continued use of the service after an update means you accept the revised terms.
11. Governing Law
These terms are governed by the laws of the Federal Republic of Germany. Mandatory consumer protection rights in your country of residence remain unaffected where applicable.
